Terms and Conditions

This translation is provided for convenience only. In the event of any discrepancy, the French version prevails.

Article 1 — Purpose and Scope

These Terms and Conditions (the "Terms") govern, without restriction or reservation, the sale of game server rental services offered by GONOTECH ("TickServ", "we") on the website https://tickserv.com (the "Site") to any private individual acting for purposes outside their trade, business, craft or profession (the "Customer", the "Consumer", "you").

Any order implies prior and unreserved acceptance of these Terms, which the Customer acknowledges having read and accepted before confirming their order. The applicable Terms are those in effect on the date of the order. They supplement the Legal Notice and the Privacy Policy.

Article 3 — Definitions

  • Account: the Customer's personal space, created via the authentication provider (Google or Discord sign-in).
  • Wallet: prepaid balance, expressed in euros, topped up by the Customer and used to pay for Server usage.
  • Credit: the amount available in the Wallet.
  • Server: a game server instance (Minecraft, Valheim, Palworld…) provisioned on demand.
  • Session: the period during which a Server is started and active.
  • Started hour: any hour begun is due in full (billing unit). The same hour is billed only once: if the Customer stops and then restarts a Server within an hour already paid for, that hour is not re-billed.

Article 4 — Description of Services (essential characteristics)

TickServ provides a digital service for renting game servers by the hour, with no fixed-term commitment. The Customer creates a Server for the game of their choice; the Server is provisioned on demand, started and stopped by the Customer, and billed for actual usage against their prepaid Wallet.

For each Server, the Customer chooses the memory (RAM) and the performance tier — Eco (shared vCPU) or Dedicated (dedicated vCPUs). The price depends on the RAM and performance tier selected (see Article 6).

How it works:

  • Start/stop on demand by the Customer from their console. Billing runs only while a Server is started.
  • Automatic shutdown when the Wallet balance is insufficient to cover the next hour, or under applicable inactivity rules, to prevent any unwanted consumption.
  • Saving of game data ("worlds"): data is saved and restored from one Session to the next, to the extent possible (best-efforts obligation — see Article 15).
  • Connection address: the address needed to join the Server is communicated to the Customer once the Server is ready.

Characteristics (games, resources, prices) may change; the version in effect at the time of the order applies. Third-party games are subject to their own licenses (see Article 13).

Article 5 — Customer Account

Creating an Account is required to place an order. Authentication is performed via a third-party provider (Google or Discord). The Customer undertakes to provide accurate information and to keep their credentials confidential. The Customer represents that they are of legal age (18 years or older) and legally capable of entering into a contract; the service is not intended for minors (payment required).

Article 6 — Price

Prices are stated in euros, all taxes included, VAT included at the applicable rate (20% for a customer residing in France; for other European Union countries, the rate of the Consumer's country of residence may apply, collected at the time of top-up).

Rental rates, per started hour, based on the memory (RAM) and performance tier selected:

  • Billing is hourly, per started hour, automatically debited from the Wallet for as long as the Server is started. Stopping and then restarting within an hour already paid for does not trigger any new charge; the next due date remains that of the current hour.
  • No mandatory subscription, no commitment: Server rental is billed solely on actual usage. The only recurring service is the optional Backups Option, described below, which is never activated without an explicit request from the Customer.
  • TickServ reserves the right to change its prices at any time; new prices apply to Sessions occurring after they take effect, with no retroactive effect.

First hour of play free

TickServ offers the Customer their first billed hour of play, without requiring or storing any payment method. The conditions are as follows:

  • One hour per Account only, granted automatically at the first hourly charge — the Customer has nothing to do and no code to enter.
  • Accounts created from August 29, 2026 onward only. Earlier Accounts are not eligible.
  • "Eco" offer, at the memory size recommended for the chosen game (the default choice on the creation form). A larger memory size or the "Dedicated CPU" tier do not qualify for the free hour; the form indicates this before confirmation.
  • The free hour takes the form of a credit applied to the Wallet at the moment it is used, equal to the hourly rate of the started Server. It appears as such in the Customer's statement. It is neither transferable, nor convertible into cash, nor refundable, and cannot fund any other service.
  • Subsequent hours are billed at the rate then in effect, against the Wallet's prepaid balance.

Backups Option (optional)

The Server keeps the Customer's world free of charge, saved on every stop and reloaded on the next start, together with a timestamped backup taken every 30 minutes during a session. The Customer may subscribe, when creating the Server or later, to a Backups Option that increases this to six timestamped backups spread over time (the most recent, then roughly 10 minutes, 1 hour, 3 hours, 24 hours and 7 days back) and reduces the capture interval to 10 minutes.

  • Price and billing period: a flat fee of €0.10 (incl. tax) per 30-day period, debited from the Wallet upon subscription and at each subsequent due date.
  • Charged independently of usage: unlike Server rental, this fee is due even while the Server is stopped, as the backups permanently occupy storage space.
  • Cancellation: the Customer may cancel at any time, in one click, from their console. Cancellation takes effect immediately; the period already begun is not refunded, and the excess backups are deleted, which is disclosed to the Customer before confirmation. The world itself is not affected.
  • Insufficient balance: if a due payment cannot be collected, the Option ends and the Server reverts to a single timestamped backup. The Customer is notified by email and in their console. No backup is deleted because of this non-payment; the excess backups then disappear through ordinary rotation.

Article 7 — Ordering and Subscription Process

  1. The Customer tops up their Wallet by the amount of their choice (immediate payment, see Article 8).
  2. The Customer creates and starts a Server; the service begins to run immediately, at their express request.
  3. Usage is debited hourly from the Wallet.

Pursuant to Article L. 221-14 of the French Consumer Code (Code de la consommation), the Customer acknowledges that confirming the order constitutes a payment obligation.

Article 8 — Payment

  • Wallet top-ups are paid by credit or debit card, via the secure payment provider Stripe. TickServ never has access to the Customer's full card details.
  • Credit becomes available in the Wallet as soon as payment is confirmed.
  • Automatic top-up (optional): if activated by the Customer, a top-up is triggered automatically when the balance falls below a threshold, according to the parameters they set. The Customer may disable it at any time from their console.
  • In the event of non-payment, rejection or fraud, TickServ may suspend access to the services.

Article 9 — Performance and Availability

TickServ provides the service on a best-efforts basis. The service is provided "as is", using reasonable best efforts. TickServ does not guarantee uninterrupted availability and may carry out maintenance operations. Game performance depends on factors beyond TickServ's control (the Customer's connection, game publishers, infrastructure host). No anti-DDoS protection of game traffic is guaranteed beyond the standard network protection of the underlying infrastructure.

Article 10 — Right of Withdrawal

As a rule, the Consumer has a period of fourteen (14) days to withdraw from a contract concluded at a distance (Article L. 221-18 of the French Consumer Code), without having to give a reason.

Creating a Server triggers no performance. Creating a Server is free and consumes nothing: no machine is allocated, no hour is billed, and the associated world is stored at no cost. Performance only begins when the Server is started, the only moment when a machine is rented and an hour becomes due.

Waiver due to immediate performance. As the Server rental service is performed immediately at the Customer's request, the Customer, before the first start of a Server, expressly requests immediate performance of the service before the end of the withdrawal period and acknowledges losing their right of withdrawal for the service as it is performed, pursuant to Article L. 221-28, 1° of the French Consumer Code. As a result, Server hours already used are non-refundable. This consent is collected once per Account (checkbox), timestamped, and applies to all Servers on that Account.

Scheduled and remotely triggered starts. The Customer may schedule start time slots or link their Server to a Discord server allowing it to be started by command. Such starts perform the service while the Customer is away from their screen: the consent above is therefore collected, if it has not already been given, when the Customer sets up the schedule or the link, and not at the time of the start.

Unused prepaid balance. The right of withdrawal and the refund of the Credit not yet used remain available under the conditions of Article 11.

Article 11 — Refund of the Prepaid Balance

The Customer may request a refund of the available, unused Credit in their Wallet at any time, by simply contacting customer support (Article 18). The refund is made to the original payment method, within a maximum of fourteen (14) days from the request. Amounts corresponding to hours already used are non-refundable (service performed).

Complimentary credit. Credit granted without payment — in particular the referral reward and promotional code bonuses — is non-transferable, non-convertible into money and non-refundable, in the same way as the free hour of play (Article 6). The refund provided for in this Article covers only the amounts actually paid by the Customer and not yet used.

Disputed or unpaid payment. Where a payment is disputed with the issuer of the payment method, or remains unpaid, TickServ reclaims the corresponding Credit together with the benefits it had triggered (in particular the referral reward), up to the available balance. The entry appears in the Customer's statement, and the Customer is informed in their account area.

Article 12 — Term, Termination and Fate of Data

The contract is concluded for the duration of use of the service, with no commitment. The Customer may stop using the service, delete their Servers and delete their Account at any time.

Upon deletion of a Server or Account, the associated data (including "worlds") is deleted and can no longer be recovered. It is the Customer's responsibility to keep a copy of their data if they wish to do so. TickServ may terminate or suspend access in the event of a serious breach of these Terms (see Article 13), after notifying the Customer unless there is an emergency or legal obligation.

Retention of worlds. A Server's "world" and its backups are kept free of storage charges and for an unlimited time as long as the Server is in use, including while the Server is stopped and while the Wallet is empty: no deletion occurs for non-payment. The inactivity counter resets to zero each time the Server is started. If a Server goes six (6) consecutive months without being started, TickServ sends the Customer two email reminders (at roughly five months, then five and a half months of inactivity) inviting them to restart their Server to keep their world; once the six months have elapsed and absent a restart, the world and its backups are deleted to free up storage space. The Account and the Server are retained: a later restart generates a new world.

Account never topped up. The free hour of play (Article 6) is not a top-up. For an Account that has never made a card top-up — neither to its Wallet nor to a shared wallet funding a Server — and from August 28, 2026 onward: the world retention period is thirty (30) days of inactivity instead of six months, with two email reminders (at 15 and 25 days); timestamped backups are kept for seven (7) days, and limited to worlds under 1 GB; the Backups Option cannot be subscribed to. These periods run from August 28, 2026 onward, never from an earlier date: no existing data is deleted before September 4, 2026 at the earliest. A single top-up, of any amount, permanently lifts these limits, even if the balance later returns to zero. The world itself remains loaded and saved on every stop in all cases, and no deletion occurs for non-payment.

Article 13 — Customer's Obligations and Responsibilities

The Customer undertakes to use the service lawfully and not to:

  • host, distribute or enable unlawful content or activity (infringement, hateful content, harm to minors, etc.) or content that infringes the rights of third parties;
  • undermine the security or integrity of the infrastructure (intrusion, unauthorized mining, denial of service, spam, abusive use of resources);
  • circumvent security measures (including anti-bot verification).

The Customer is solely responsible for the content they install and for the use of their Servers, as well as for complying with the licenses and terms of the third-party games and software they run (e.g., the Minecraft/Mojang End User License Agreement and the terms of the server images used). Any breach may result in the immediate suspension of the Server concerned.

The service is not a hosting or file-sharing service. The storage space associated with a Server, the world import/export functions and the file manager are provided for the sole purpose of running that game Server. The Customer undertakes not to use them to store or distribute files unrelated to the operation of their Server, nor to repurpose the temporary download links provided to them as a means of distribution to third parties. These links are personal and short-lived, and TickServ may reduce their validity, cap the volumes uploaded, or suspend access to the transfer functions in the event of clearly unrelated use of a game Server.

Article 14 — Statutory Conformity Guarantee for Digital Services

The service provided is a digital service within the meaning of Articles L. 224-25-1 et seq. of the French Consumer Code. The Customer benefits from the statutory conformity guarantee: TickServ must provide a conforming service and is liable for any lack of conformity existing at the time the service is supplied. In the event of a defect, the Customer may obtain the bringing of the service into conformity or, failing that, a price reduction or termination of the contract, under the conditions set out by law. This guarantee applies independently of any commercial guarantee.

Article 15 — TickServ's Liability

TickServ is subject to a best-efforts obligation. Its liability cannot be engaged in the event of:

  • force majeure or the act of a third party (game publisher, infrastructure host, network operator);
  • misuse, misconfiguration, or an act of the Customer;
  • loss of game data: "world" backups are performed on a best-efforts basis and do not constitute a guarantee of retention; it is the Customer's responsibility to back up their important data.

In any event, and to the extent permitted by law, TickServ's liability to the Customer, for all damages combined, is limited to the amount actually spent by the Customer over the three (3) months preceding the event giving rise to liability. Nothing in these Terms limits TickServ's liability in the event of willful misconduct (dol), gross negligence, or bodily injury, or excludes the Consumer's mandatory statutory rights.

Article 16 — Personal Data

The processing of personal data is described in the Privacy Policy, which complies with the GDPR and the French "Informatique et Libertés" law. The Customer will find there the purposes, legal bases, retention periods, sub-processors (including for authentication, payment and hosting) and how to exercise their rights.

Article 17 — Intellectual Property

The Site, its visual identity, its trademarks and its content are protected and remain the property of TickServ or its partners. Third-party games, trademarks and content remain the property of their respective owners. No transfer of rights is granted to the Customer beyond the right to use the service.

Article 18 — Customer Service and Complaints

For any question or complaint: support@tickserv.com, +33 6 36 23 17 61, or by post to the registered office (Article 2). In accordance with Article L. 121-16 of the French Consumer Code, this number is not premium-rate: calls are charged at your operator's standard rate.

Email is the preferred channel: it lets you attach whatever the request needs (server ID, screenshot, log excerpt) and keeps a written record of the exchange — a record that is in any case required before referring a dispute to the mediator (Article 19, which presupposes a prior written complaint). The telephone line remains open for requests that suit it. TickServ endeavors to respond as promptly as possible.

Article 19 — Consumer Mediation

Pursuant to the provisions of the French Consumer Code on the consumer dispute mediation process (Articles L. 612-1 et seq.), after contacting us and failing to obtain a satisfactory response, you may refer the matter free of charge to the consumer mediator designated by TickServ:

Referral to the mediator requires that a written complaint has first been sent to TickServ (Article 18) without obtaining satisfaction or without any reply. It must be made within less than one year of that written complaint (Article R. 612-2 of the French Consumer Code).

Article 20 — Applicable Law and Disputes

These Terms are governed by French law. In the event of a dispute, the Consumer may bring proceedings before any court with territorial jurisdiction under the French Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R. 631-3 of the French Consumer Code). Recourse to mediation (Article 19) remains available before any court action.

Article 21 — Amendment of the Terms

TickServ may amend these Terms. The applicable Terms are those in effect on the date of the order. In the event of a material change, the Customer will be informed; continued use of the service after the change takes effect constitutes acceptance of the new Terms for subsequent orders.
